The Commercial Court
The rules of the Commercial Court currently provide that a judge may, on his/her own motion, or on the application of any of the parties, adjourn the matter before the Court for a period not exceeding 28 days to allow the parties to consider mediation. The latest statistics from the Court indicate that almost two thirds of the cases referred to mediation were successfully settled. The parties involved cited cost savings, time saved, relationships saved, control of the process and confidentiality as the main attractions of mediation.
